Welcome to SHOTON APP. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

Important Note

These Terms constitute a legally binding agreement between you and SHOTON APP. Please read them carefully.

1. Service Description

SHOTON APP is a free, browser-based tool that allows users to add camera watermarks to photos using EXIF metadata. Key features include:

  • Client-side image processing (no uploads to our servers)
  • Film preset filters and color grading
  • Basic image adjustments (exposure, contrast, saturation, temperature)
  • EXIF metadata editing and display

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice.

2. Eligibility and Age Requirements

You must be at least 13 years of age to use SHOTON APP. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using our service, you represent and warrant that you meet these age requirements.

3. Acceptable Use

By using this service, you agree to:

Permitted Uses

  • Use the service only for lawful purposes
  • Process only images that you own or have proper authorization to use
  • Use the service in accordance with these Terms and applicable laws

Prohibited Uses

You agree NOT to:

  • Use the service to process, create, or distribute illegal, harmful, or infringing content
  • Process images containing child sexual abuse material (CSAM) or exploitative content
  • Violate any intellectual property rights, including copyrights and trademarks
  • Attempt to reverse engineer, decompile, or extract source code from the service
  • Use automated systems (bots, scrapers) to access the service without permission
  • Interfere with or disrupt the service or servers
  • Circumvent any security measures or access controls
  • Use the service to harass, abuse, or harm others
  • Impersonate any person or entity
  • Distribute malware, viruses, or harmful code
  • Use the service for any commercial purpose without our written permission (personal and non-commercial use is permitted)

We reserve the right to investigate violations and cooperate with law enforcement authorities.

4. Intellectual Property

Your Content

You retain all rights, title, and interest in the images you process using SHOTON APP. We:

  • Do not claim any ownership over your content
  • Do not access, store, or have any rights to your images
  • Do not receive any license or rights to your images

You are solely responsible for ensuring you have the necessary rights to any images you process.

Our Service

The SHOTON APP service, including but not limited to its:

  • Website design, layout, and user interface
  • Source code and software
  • Features and functionality
  • Branding, logos, and trademarks
  • Documentation and content

is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for personal, non-commercial purposes, subject to these Terms. This license does not permit you to:

  • Copy, modify, or create derivative works
  • Sell, rent, lease, or sublicense access to the service
  • Reverse engineer or attempt to extract source code

5. Privacy and Data

Client-Side Processing

All image processing is performed locally in your browser using JavaScript and the Canvas API. Your photos:

  • Are never uploaded to our servers
  • Remain entirely on your device
  • Are cleared from browser memory when you close the tab

We do not have access to, store, transmit, or process your images in any way.

Analytics

We use Google Analytics to understand how our service is used. Please refer to our Privacy Policy for complete details about data collection and your privacy rights.

6. Service Availability and Changes

No Guarantee of Availability

We strive to maintain service availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

  • Maintenance or updates
  • Technical issues or server problems
  • Circumstances beyond our control

Right to Modify or Discontinue

We reserve the right to:

  • Modify, update, or discontinue features at any time
  • Change these Terms (with notice as described in Section 10)
  • Terminate the service entirely

Free Service

SHOTON APP is currently provided free of charge. We reserve the right to introduce fees for certain features in the future, with advance notice to users.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHOTON APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or quality of results
  • Warranties that the service will meet your specific requirements
  • Warranties that defects will be corrected

You use the service at your own risk. No oral or written information provided by us shall create any warranty.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

No Liability for Damages

We shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Loss or corruption of images or files
  • Costs of substitute services
  • Damages resulting from your use of or inability to use the service
  • Damages arising from third-party services (e.g., Google Analytics)
  • Damages from unauthorized access to your device or data

Maximum Liability

In any event, our total liability to you for all claims arising from or related to the service shall not exceed $100 USD or the amount you paid us in the past 12 months (whichever is greater). Since the service is free, this effectively limits our liability to $100 USD.

Basis of the Bargain

You acknowledge that we have made the service available to you in reliance upon these limitations of liability, which reflect a reasonable allocation of risk and form an essential basis of the bargain between us.

9. Indemnification

You agree to indemnify, defend, and hold harmless SHOTON APP, its owners, operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any rights of third parties, including intellectual property rights
  • Any images you process through the service
  • Your violation of any applicable laws or regulations

10. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our practices, service, or legal requirements. When we make changes:

  • We will update the "Effective Date" at the top of these Terms
  • We will post the revised Terms on this page
  • For material changes, we may provide additional notice through the service

Your continued use of the service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the service.

11. Termination

Your Right to Terminate

You may stop using the service at any time. Since no account is required, simply stop accessing the website.

Our Right to Terminate

We reserve the right to:

  • Terminate or suspend your access at any time, with or without cause, with or without notice
  • Investigate suspected violations of these Terms
  • Take appropriate legal action for violations

Effect of Termination

Upon termination:

  • Your right to use the service immediately ceases
  • Provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination

12. Dispute Resolution and Arbitration

Informal Resolution

Before filing a claim, you agree to contact us at info[at]shoton.app to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

Arbitration Agreement

If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service shall be settled by binding arbitration, rather than in court, except that:

  • You may assert claims in small claims court if they qualify
  • Either party may seek injunctive or equitable relief in court for intellectual property matters

The arbitration shall be conducted by a neutral arbitrator and governed by applicable arbitration rules.

Class Action Waiver

You agree to bring claims only in your individual capacity, and not as a plaintiff or class member in any purported class, representative, or collective proceeding.

Exceptions

This arbitration provision does not apply to users in jurisdictions where such clauses are prohibited by law (e.g., certain EU countries).

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

For disputes not subject to arbitration, you agree to submit to the personal jurisdiction of the state and federal courts located in the United States.

If you are accessing the service from outside the United States, you are responsible for compliance with local laws.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SHOTON APP regarding the service and supersede any prior agreements or understandings.

16. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.
